Wellversed offers an online platform that provides a wide range of health supplements, functional foods, and nutrition products for sale, as well as related services such as product information, personalized health recommendations, customer support, and content for educational purposes. By using the Website, you have access to browse, purchase, and engage with the Products and services offered.By accessing, browsing, registering, or using the Website in any manner, you represent that you have read, understood, and agree to comply with and be bound by these Terms and Conditions. 6. Account Registration and Security

You acknowledge that failure to provide accurate, complete, or current information may result in your inability to access certain features of the Website, the termination of your account, or the suspension of services.

You agree to take all necessary precautions to prevent unauthorized access to your account. By submitting reviews, feedback, comments, or any other content (collectively, "User Content") to the Website, you grant Wellversed Health Private Limited a worldwide, irrevocable, and royalty-free license to use, modify, distribute, and display your User Content in connection with the Website and for any promotional, advertising, or commercial purposes, including but not limited to social media posts, print media, and other marketing channels.

2. While we encourage user feedback and reviews, we reserve the right to moderate, edit, or remove any User Content that violates our guidelines or terms, including content that is defamatory, offensive, unlawful, or violates any third-party rights. 3. You acknowledge that you will not be compensated for the submission of any User Content and that any content you provide is voluntarily submitted. You also agree that Wellversed is not obliged to use or display any of your User Content.

4. You retain ownership of the User Content you submit, but by posting it on the Website, you grant Wellversed a license to use it as described above. If you no longer want Wellversed to use your User Content, you may contact us at support@wellversed.in, and we will make reasonable efforts to remove it from the Website, subject to applicable laws and circumstances.

8. Promotional Communication

1. By using the Website, you agree that Wellversed may send you marketing communications, including but not limited to information about our products, services, sales promotions, newsletters, SMS updates, and communications related to our group companies or business partners.

9. Electronic Communication

All agreements, notices, disclosures, and other communications that Wellversed provides electronically satisfy any legal requirement that such communications be in writing.

2. By providing your phone number and email address, or by requesting a callback, you consent to receive calls, SMS, emails, or other communications related to your account, orders, or our services.

10. Health- Related Information

1. All health-related information provided on the Website, including but not limited to content created or shared by healthcare or nutrition professionals associated with Wellversed Health Private Limited, is intended solely for informational purposes. It is not a substitute for professional medical advice, diagnosis, or treatment. You should not use any information on or through the Website to diagnose or treat any health condition, disease, or prescribe medication. Always consult with a qualified healthcare provider before making any health-related decisions.

2.  You should carefully read all information provided on the Product packaging prior to use. Individual results from using our Products may vary, and no specific result should be construed as typical or guaranteed.

11. Limitation of Liability

1. To the fullest extent permitted by applicable law, Wellversed Health Private Limited, its affiliates, suppliers, licensors, or third-party service providers shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to, loss of profit, revenue, goodwill, data, or business interruption, arising out of your use of the Website or Products, even if we were advised of the possibility of such damages. Our total liability, in any case, shall be limited to the value of the Products purchased by you in connection with the claim, and the remedies provided are exclusive and in lieu of all other legal remedies.

13. Order Acceptance and Cancellation

1. By placing an order on the Website, you make an offer to purchase the selected Products. However, your order is not binding on Wellversed Health Private Limited until it has been confirmed. An order is deemed accepted only when Wellversed sends you an email or other communication acknowledging and confirming the acceptance of your order (“Order Confirmation”). Until such confirmation is provided, Wellversed reserves the right to refuse or cancel your order at its sole discretion.

14. Shipping & Delivery

         All orders received are subject to acceptance and availability. Orders are typically processed and dispatched within one (1) business day (i.e., within 24 hours) of order confirmation, unless otherwise specified.

      2. Delivery Timeline 

         1. For deliveries within India (excluding Delhi NCR), orders are expected to be delivered within 5 to 7 business days from the date of dispatch.

         2. For deliveries within the Delhi National Capital Region (NCR), orders are expected to be delivered within a maximum of 3 business days from the date of dispatch.

         3. These timelines are estimates only and are subject to change based on logistics, weather conditions, and other unforeseen factors outside the control of Wellversed Health Private Limited.

      All orders received are subject to acceptance and availability. Orders are typically processed and dispatched within one (1) business day (i.e., within 24 hours) of order confirmation, unless otherwise specified.

   3. Order Tracking and Updates
      Once your order is dispatched, you will receive a tracking link via WhatsApp, Email, and SMS. This link will provide regular updates on the estimated delivery date and shipment status. You can also track your order anytime through the 'Track Your Order' page on our website.

   4. Shipping Fees
      Currently, all orders placed on the Wellversed Health Private Limited website are eligible for free shipping. Any future shipping charges, if applicable, will be clearly communicated at the time of order placement.
      

15. Return and Refunds

1. Wellversed does not accept returns under any circumstances. Due to the nature of the products we offer, all sales are final. If there is a defect with the product or a shipping error, please contact us at support@wellversed.in within 48 hours of receiving your order.

2. Refunds may be issued only if the product is defective, damaged, or the wrong product was delivered. In such cases, a refund will be issued through the original payment method or as store credit, depending on the situation. All requests for refunds are subject to approval after investigation.

16. Non-Returnable Item 

    16.1 The following categories of goods are expressly excluded from the right of return or refund and are non-returnable under any circumstances:

     

    1. Gift cards and wallet balances 
       

    2. Health Transformation Plans, Diet Plans, and any personalized consultation or service plans.

    3. Downloadable software, digital products, or any content delivered electronically.

    4. Products that have been opened, used, or partially consumed, including but not limited to health supplements, consumables, or perishable goods.

    5. Promotional items, freebies, or gifts provided in conjunction with any purchase.

    6. Limited edition (eg: shakers) , bespoke, customized, or personalized products that are made to order or specifically tailored to the customer’s specifications.

    7. By placing an order for any such items, you expressly acknowledge and agree that these items are not eligible for return, exchange, or refund.

17. Dispute and Complaint Resolution

    1. General Complaints: Resolved within seventy-two (72) business hours from receipt.

    2. Shipment Damage Claims: Require submission of sufficient proof, including an unboxing video, to initiate an investigation.

    3. Customer Escalations: Prioritized and addressed within twenty-four (24) hours by our dedicated support team.

    1. If your order is marked as delivered but you have not received it, you must raise a dispute within 24 hours of receiving the delivery notification.

    2. Proof of Delivery (POD) documentation is retained and available for up to seven (7) days after delivery. Delivery-related disputes must be reported in accordance with courier guidelines.

       18. Force Majeure

       1. Wellversed Health Private Limited shall not be liable for any failure or delay in the performance of its obligations under this Agreement, including but not limited to, the delivery of products, provision of services, or any other obligations, if such failure or delay is due to any cause or circumstance beyond its reasonable control (hereinafter referred to as "Force Majeure Event").

       2. A Force Majeure Event includes, but is not limited to, acts of God, natural disasters, war, terrorism, civil disturbances, labor strikes, pandemics, government actions, changes in law, fire, flood, earthquake, epidemic, blackout, breakdown of equipment, failure or delay of third-party services or delivery systems, or any other event beyond the control of Wellversed Health Private Limited.

       3. In the event of a Force Majeure Event, Wellversed Health Private Limited shall make reasonable efforts to mitigate the impact and resume performance as soon as reasonably possible 

           

           

        

19. Termination 

1. Termination by User
   The User Agreement is effective until terminated by either you (the "User") or Wellversed Health Private Limited. You may terminate your Account (and thus the User Agreement) at any time by notifying us in writing via email at support@wellversed.in of your desire to do so. Upon receiving such notice, we will process your request to close your account. Any termination of your Account will be effective immediately.

2. Termination by Wellversed
   We reserve the right to terminate your Account (and hence the User Agreement) at any time, with or without cause, by providing you with a notice. Such termination will be effective within 24 hours of our notice to you, and we may deny you access to the Website and/or Services. Termination by Wellversed may occur in cases where you violate these Terms and Conditions, or in any other situation where we deem termination to be appropriate. Termination by us will be without any liability to Wellversed Health Private Limited.

3. Obligations upon Termination
   Upon termination of your Account or this Agreement for any reason, you agree to immediately cease using the Website and any Services. You must also promptly destroy any materials, content, or products downloaded or otherwise obtained from the Website, as well as any copies of such materials, whether made under the User Agreement or otherwise.

4.  Survival of Terms
   Certain provisions of these Terms will survive termination, including but not limited to those related to ownership of intellectual property, limitations of liability, and indemnification. Our right to any Comments you have provided will also survive any termination of your Account.

5. Cancellation of Outstanding Orders
   Following the termination of your Account, you will no longer have access to the Website or the Services. In addition, Wellversed Health Private Limited reserves the right to cancel any outstanding orders for Products that have not yet been processed or dispatched, at its sole discretion, after notifying you.

6. Unauthorized Access Post-Termination
   Upon termination, Wellversed Health Private Limited reserves the right to take necessary actions to prevent unauthorized access to the Website and Services, including but not limited to blocking access or using other means deemed necessary to protect the Website and its Users.

22. Governing Law and Dispute Resolution

1. This Agreement, including all matters arising out of or relating to the use of the Website or the Products, shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

You hereby agree that any disputes, controversies, or claims arising out of or relating to this Agreement, including its breach, termination, or validity, shall be subject to the exclusive jurisdiction of the courts located in Gurugram, Haryana, India. You irrevocably waive any objection to such jurisdiction and venue.

23. SEVERABILITY

1. If any provision or part thereof of this Agreement is determined to be invalid, illegal, or unenforceable by a court or arbitral tribunal of competent jurisdiction, such provision shall be deemed modified or severed to the minimum extent necessary to render it valid and enforceable. The remaining provisions of this Agreement shall continue in full force and effect and shall not be affected or impaired by such invalidity, illegality, or unenforceability.
